Who must register?

Any covered offender must register. A covered offender is a sex offender or an offender against minors, as defined in Chapter 846E, HRS.

Who is a Sex Offender?

According to Chapter 846E-1, HRS, "sex offender" means:

(1)

A person who is or has been convicted at any time of a "sexual offense"; or
(2)

A person who is or has been charged at any time with a "sexual offense" and is or has been found unfit to proceed and is or has been released into the community or who is acquitted due to a physical or mental disease, disorder, or defect pursuant to chapter 704 and is released into the community.

According to Chapter 846E-1, HRS, a "sexual offense" means an offense that is:

(1)
Set forth in section:
- Sexual Assault in the First Degree, HRS 707-730;
- Sexual Assault in the Second Degree, HRS 707-731;
- Sexual Assault in the Third Degree, HRS 707-732;
- Sexual Assault in the Fourth Degree, HRS 707-733(1)(a);
- Continuous Sexual Assault of a Minor under the age of Fourteen Years, HRS 707-733.6,
- Promoting Prostitution in the First Degree, HRS 712-1202(1)(b); or
- Promoting Prostitution in the Second Degree, HRS 712-1203(1)(b),
but excludes conduct that is criminal only because of the age of the victim, as provided in section 707-730(1)(b), or section 707-732(1)(b) if the perpetrator is under the age of eighteen;
(2)

An act defined in HRS section 707-720, Kidnapping, if the charging document for the offense for which there has been a conviction alleged intent to subject the victim to a sexual offense;
(3)
An act that consists of:
- (A)
  
  Criminal sexual conduct toward a minor, including but not limited to an offense set forth in HRS section 707-759, Indecent Electronic Display to a Child;
- (B)
  
  Solicitation of a minor who is less than fourteen years old to engage in sexual conduct;
- (C)
  
  Use of a minor in a sexual performance;
- (D)
  
  Production, distribution, or possession of child pornography chargeable as a felony under HRS sections 707-750, Promoting Child Abuse in the First Degree, 707-751, Promoting Child Abuse in the Second Degree, or 707-752 Promoting Child Abuse in the Third Degree;
- (E)
  
  Electronic Enticement of a Child chargeable under HRS sections 707-756, 707-757, if the offense was committed with the intent to promote or facilitate the commission of another covered offense as defined in section 846E-1; or
- (F)
  
  Solicitation of a minor to practice prostitution;
(4)

A criminal offense that is comparable to or that exceeds a sexual offense as defined in paragraphs (1) through (3) or any federal, military, or out-of-state conviction for any offense that under the laws of this State would be a sexual offense as defined in paragraphs (1) through (3); or
(5)

An act, as described in HRS Chapter 705, that is an attempt, criminal solicitation, or criminal conspiracy to commit one of the offenses designated in paragraphs (1) through (4).

Who is an Offender against a Minor?

According to Chapter 846E-1, HRS, "offender against minors" means a person who is not a "sex offender," as defined in Chapter 846E, and is or has been:

(1)

Convicted at any time of a "crime against minors" as defined in Chapter 846E; or
(2)

Charged at any time with a "crime against minors" as defined in Chapter 846E and who is found unfit to proceed and is released into the community or who is acquitted due to a physical or mental disease, disorder, or defect pursuant to Chapter 704 and is released into the community.

According to Chapter 846E-1, HRS, "crime against minors" excludes "sexual offenses" as defined in Chapter 846E, HRS and means a criminal offense that consists of:

(1)

Kidnapping of a minor, by someone other than a parent;
(2)

Unlawful imprisonment in the first or second degree that involves the unlawful imprisonment of a minor by someone other than a parent;
(3)

An act, as described in chapter 705, that is an attempt, criminal solicitation, or criminal conspiracy to commit one of the offenses designated in paragraph (1) or (2); or
(4)

A criminal offense that is comparable to or which exceeds one of the offenses designated in paragraphs (1) through (3) or any federal, military, or out-of-state conviction for any offense that, under the laws of this State would be a crime against minors as designated in paragraphs (1) through (3).

For how long does an offender have to register?

Hawaii's registry is a lifetime registration, unless after certain requirements are met, the offender successfully petitions the court to terminate the registration requirement.

How and how often is the registration information verified?

(1)

Unless the covered offender is incarcerated or has registered with a designated law enforcement agency after establishing residence in another state, every January, April, July, and October, the Department of Attorney General mails a non-forwardable verification form to the last reported address of the covered offender. The covered offender shall sign the verification form and state that he/she still resides at the last reported address and that no other registration information has changed or shall provide the new information. The covered offender shall mail the signed and completed verification form to the Attorney General within ten days after receipt of the form.
(2)

Beginning July 1, 2009, each covered offender shall report in-person every year, within the thirty-day period following the offender's date of birth, to the chief of police where the covered offender resides and shall review the existing information in the registry, correct any information that has changed or is inaccurate, provide any new information that may be required, and allow the police to take a current photograph.
(3)

If the covered offender does not have a residential address, the covered offender must report in person to the police department by the last day of every month for verification of information as required by law.

Who qualifies to be on the website?

All covered offenders qualify to be on the website, with the exception of covered offenders who have been convicted of only one covered offense and that covered offense is a misdemeanor.

Where are Public Access terminals available?

Public Access terminals are located at the Hawaii Criminal Justice Data Center and at main county police departments, including the Kona Police Station from 8:00 a.m. to 4:30 p.m., Monday through Friday, except State holidays.

How often is the website updated?

The official Hawaii Covered Offender website, http://sexoffenders.ehawaii.gov/sexoffender, is updated nightly.

Does the State of Hawaii require the registration of juvenile offenders who are adjudicated in proceedings in Family Court as juveniles?

No.

Are there restrictions on where a covered offender can reside or work?

Chapter 846E, HRS, does not restrict where a registered covered offender may reside or work. However, certain covered offenders, still under supervision, may have restrictions in their Terms and Conditions of supervision. For example, a judge may order that a registered covered offender may not contact or attempt to contact, directly or indirectly, any minor child, or reside in the same residence with minor children, without permission from the supervision officer. Restrictions may also arise in other circumstances as well.

If I receive a flyer on a covered offender, may I pass it out in my neighborhood?

The public is given access to information regarding covered offenders pursuant to Chapter 846E, HRS. Public access to this information is based solely on the fact of each offender's criminal conviction and is not based on an estimate of the offender's level of dangerousness. By allowing public access to this information, the State makes no representation as to whether the covered offenders listed are dangerous. Any person who uses the information in this registry to injure, harass, or commit a criminal act against any person included in the registry may be subject to criminal prosecution, civil liability, or both.

Additionally, because the registry and website are updated daily and on an on-going basis, please consider that any information you print out from the website will only be as current as the date and time at which you printed it.

Positive identification of a person believed to be a covered offender cannot be established unless the person's fingerprints are compared against the offender’s fingerprints taken at the time of arrest or incarceration.

The U.S. Department of Justice provides the National Sex Offender Public Website at http://www.nsopw.gov.

How can I find out if there are any registered covered offenders in my area?

You may search the Hawaii Covered Offender Website, http://sexoffenders.ehawaii.gov/sexoffender by street name and zip code or by zip code alone.

I am a registered covered offender in another state and am going to visit Hawaii. What do I need to do?

You must comply with Chapter 846E, HRS and are required to register no later than three working days upon arrival in Hawaii. According to Chapter 846E, HRS, registration is required whenever a covered offender, whether or not a resident of Hawaii, remains or expects to remains in Hawaii for more than ten days, or for an aggregate period of thirty days in one calendar year.

When must a covered offender register?

Covered offenders required to register in person with the chief of police under Chapter 846E, HRS, shall register no later than three working days after the earliest of:

(1)

Arrival in this State;
(2)

Release from incarceration;
(3)

Release from commitment;
(4)

Release on furlough;
(5)

Conviction for a covered offense, unless incarcerated;
(6)

Release on probation;
(7)

Placement on parole; or
(8)

Arrival in a county in which the covered offender resides or expects to be present for a period exceeding ten days.

Where do I go to register?

You must register with the chief of police of the county in which you reside or are present, or to such other department or agency designated by the attorney general. Below are the current registration facilities. All covered offender registration hours are 8:00 a.m. to 4:00 p.m, Monday through Friday, except State Holidays, unless otherwise stated.

I am a registered covered offender and have changes to my registration information. How do I update the registry?

When a covered offender provides notice of a change in registration information, the covered offender shall also sign a statement verifying that all the registration information is accurate and current. You may do this by any of the following methods below:

(1)

Print, fill in, sign, date, and mail a Covered Offender Update Form to the Hawaii Criminal Justice Data Center.
(2)

Mail a signed written statement with the changes to your record to the Hawaii Criminal Justice Data Center
(3)

Report in-person to the Hawaii Criminal Justice Data Center or an approved police station and fill out a Covered Offender Registration Record form.

What if a covered offender does not comply with the registration requirements set forth in Chapter 846E?

Failure to comply with Chapter 846E is a class C felony offense.

How do I download the entire list of covered offenders or obtain bulk data?

Bulk Covered Offender Registration (COR) information is available for purchase. The download will include information that is considered "public information" as provided in §846E-3.
